What is a Local Planning Scheme?

A Local Planning Scheme is a legal document that sets out policies and controls how land in a particular local government area can be used and developed. It contains information about long term planning and strategies and about how infrastructure and development will occur in the area.

The Shire’s local planning is often known as LPS9 and it classifies land into zones and outlines how land within those zones may be used and developed.

All local planning schemes in WA contain ‘deemed provisions’ that outline uniform processes and procedures. The ‘deemed provisions’ are mandated by State legislation and cannot be altered or varied.

Why do we have a Local Planning Scheme?

The Shire of Gingin is responsible for planning its local communities by ensuring appropriate planning controls exist for land use and development. The Shire does this by preparing and administering a Local Planning Scheme and Strategy.

Local governments are required to prepare a Local Planning Scheme in accordance with the Planning & Development Act 2005 and the relevant regional planning scheme.

How does a Local Planning Scheme affect my property?

LPS9 provides the basis for how land may be used and developed in the Shire. This includes:

  • The zoning of your property and types of land uses that may be allowed to operate from a site;
  • The Residential Design Code density number that applies to your property which prescribes how many dwellings can be developed; and
  • The requirements to obtain Development (planning) Approval
