The Shire of Gingin wishes to update community members on a current legal matter between VIMG WA Pty Ltd and the Shire of Gingin relating to the Lancelin South development.
In a lawyers’ letter dated 28 February 2025, VIMG has challenged the validity of the deed arrangements between VIMG entities and the Shire of Gingin. VIMG has subsequently commenced litigation in the Supreme Court which challenges the validity of the deed arrangements.
VIMG have claimed that the deed arrangement is invalid and not binding on the VIMG entities, and they would not be abiding by the terms of those deeds. The terms of the deeds include the developer constructing or paying contributions towards community infrastructure that the Shire of Gingin deems necessary to appropriately service the population.
The Shire of Gingin is actively defending the Supreme Court case brought by VIMG against the Shire and will be arguing that the existing deed arrangement is valid. The case will be heard in the Supreme Court in late July 2025.
As this is an ongoing legal matter, the Shire of Gingin is unable to share details of the dispute as it may impact the case yet to be heard in the Supreme Court.
