As a follow up to the previous public statement made in May 2025, the Shire of Gingin would like to provide a brief update to community members regarding the ongoing legal matter between VIMG WA Pty Ltd and the Shire of Gingin relating to the Lancelin South development.
Earlier in the year, VIMG challenged the validity of the infrastructure contribution deed arrangement between VIMG entities and the Shire of Gingin.
VIMG have claimed that the deed arrangement is invalid and not binding on the VIMG entities, and they would not be abiding by the terms of those deeds. The terms of the deeds require VIMG to undertake or contribute towards community infrastructure that the Shire of Gingin deems essential. The Shire is actively defending the court case and maintains that the existing deed arrangements are valid and enforceable.
The case between VIMG and the Shire of Gingin was due to be heard in the Supreme Court but has since been adjourned to see if the matter can be settled out of court. A directions hearing is scheduled for November 2025 which will set a new court hearing date, if no settlement is reached prior to then.
As this is an ongoing legal matter, we are limited in the information we can share at this stage, as doing so could impact the case. However, we are committed to keeping the community informed and will provide updates as soon as details can be shared.
